We at Imagine Health and Insurance Corporate Agency Private Limited ('Alyve Health', 'We', 'Us', 'Our') know that you as a user ('You', 'Your', ‘User(s)’, ‘Customer(s)’, ‘Member(s)’) care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our privacy policy. By visiting or using our website (www.alyve.health) and domain name, and any other linked pages, features, content, mobile applications, or any other services we offer from time to time by in connection therewith (collectively, the 'Mobile App'), or by using the Services / Products in any manner, you acknowledge that you accept the practices and policies outlined in this privacy policy, and you hereby consent that we will collect, use, and share your information in the following ways.

What does this privacy policy cover?

This privacy policy covers our treatment of personally identifiable information ('personal information') that we gather when you are accessing or using our Mobile App , website and through Uniform Resource Locator links (URLs) that we host on our servers. We may also collect this information through your group administrators (authorized leaders / heads of functions / heads of associations or similar group bodies). This policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.

Who does the privacy policy impact?

This policy impact all our users. However, the policy impacts users differently based on whether they live in India or outside India. Our mobile app is currently available for download only within India and for users with Indian mobile numbers. Our website and URLs can be accessed anywhere. When users access our products and/or services through our website or URLs, the manner we determine whether our users live in India or outside India is through the ISD code of the mobile number that users use to register. ISD code of +91 is tagged to “Within India users” as per this document and all other ISD codes are tagged to “Outside of India users”.

Our mobile app is live currently only for users within India. Users outside of India can access our website and purchase a few limited offerings currently. For users registering / purchasing/participating in our programs from outside India, we collect the following details : Full name, mobile number and email id. We collect this information to revert to you details around the way you can join the sessions as part of your program and to update you on any upcoming programs that you may be interested in. We also collect information pertaining to the specific program that you are looking to register / purchase / participate in – such as (and not limited to) – the time slot which you want to book, the number of tickets you want to purchase and so on. To facilitate payments, we have partnered with payment gateway(s) with standard security protocols. We do not process your payments ourselves ; therefore, please refer to the privacy policy of our payment gateway provider(s) for more information on the standards employed to keep your data safe. We use third party video conference software to facilitate your classes / sessions; therefore, please refer to the privacy policy of our partner(s) for more information on the standards employed to keep your data safe.

What information does Alyve Health collect?

We gather various types of personal information from our users, as explained more fully below. We may use this personal information to personalize and improve our services, to allow our users to set up a user account and profile, to create communities, to fulfil requests for certain products and services, to analyse how users utilize the Mobile App and Product, and as otherwise set forth in this privacy policy. We may share certain types of personal information with third parties. We collect the following types of information:

Information you provide to us:

We receive and store any information you knowingly provide to us. For example, we collect personal information such as your name, personal email address, corporate email address, residence and office address, gender, birth date, weight, height, location, nutrition data, photographs, check-ins, symptoms, travel history and medical history. We may collect other sleep, activity, or health-related information as our services and products are further developed. You can choose not to provide us with certain information, but then you may not be able to register with us or to take advantage of some of our features / Products.

Alyve Health would like to access your contacts in order to invite your contact(s) to your communit(ies). If you consent, the mobile number and name of your contact(s) will be saved in an encrypted manner on our servers.

Information provided by your group administrators:

When group administrators register members in communities, they provide us with the following information – Name, mobile number, email id, department name & id, location. We collect this information to enable you to join such communit(ies) and participate in its activities. Information collected automatically:

When you share your iOS Health app data with our Products, that data is covered by the privacy policy. We handle all iOS Health app and HealthKit data in accordance with Apple's development guidelines. Alyve Health's use and transfer of information received from Google APIs adhere to Google API Services User Data Policy, including the Limited Use requirements.

Whenever you interact with our Mobile App, we automatically receive and record information on our server logs from your browser including your IP address, 'cookie' information, and the page you requested. 'Cookies' are identifiers we transfer to your computer or mobile device that allow us to recognize your browser or mobile device and tell us how and when pages in our Mobile App are visited and by how many people. You may be able to change the preferences on your browser or mobile device to prevent or limit your computer or device's acceptance of cookies, but this may prevent you from taking advantage of our Mobile App's best features.

When we collect usage information (such as the numbers and frequency of visitors to the Mobile App), we only use this data in aggregate form, and not in a manner that would identify you personally. For example, this aggregate data tells us how often users use parts of the Mobile App, so that we can make the Mobile App appealing to as many users as possible. We may also provide this aggregate information to our partners; our partners may use such information to understand how often people use our Mobile App, so that they, too, can provide you with an optimal online experience. We never disclose aggregate information to a partner in a manner that would identify you personally.

If you are using our Products, you understand and acknowledge that, any information, data or readings from the Product, or collected from Your use thereof, will be automatically uploaded to your account with us. To the extent these automatically collected readings can be used to personally identify you, these readings are personal information for the purposes of this privacy policy.

Who can access Alyve Health products and services?

Individuals over 12 years old and residing in India can access our services. Companies registered in India can access our corporate solutions / services

What channels will Alyve Health use to provide its products and services?

We will primarily employ our mobile app and our website. For a few services, we would also employ third party applications like Whatsapp, Zoom, Google Meet, Jio Meet.

Internet bandwidth is a pre-requisite to access many of our services. We will not be held liable for slow / non response of app / our services /third party services due to slow / patchy internet services.

How will Alyve Health use the information it collects?

We neither rent nor sell your personal information . Your information would be employed in aggregate form (not personally identifiable) to show comparisons across communities and to provide insights thereof.

Your information would also be shared with experts advising you based on the specific products / programs you purchase. These experts include doctor(s), habit coach(es), nutritionist(s), yoga / fitness instructor(s) and other similar expert(s). This will enable the experts to provide personalized and effective services to you. To be specific, in terms of the diverse services, the company shall share your personally identifiable information with only such third parties (persons or companies) in relation to whom you provide express consent.

Your information would also be shared with your group administrators in an anonymous / aggregated manner. This helps your corporate administrator to budget for and plan health and wellness activities in your group. In the case where your group is financing your transactions on our app, we may need to provide usage information against such transactions made by you. If you wish to stop accessing the services of such communi(ties), you are free to exit at anytime.

E-mail and other communications:

We may contact you, by email or other means; for example, we may send you promotional offers, or communicate with you about your use of the Mobile App or the Product. Also, we may receive a confirmation when you open an email from us. This confirmation helps us make emails more relevant for you and improve our services.

Is personal information about me secure?

The App is equipped with standard security features to protect the confidentiality and security of your information. We shall maintain and implement reasonable and appropriate security procedures consistent with prevailing industry standards and all applicable laws to protect personal data from any unauthorized access or use. We shall maintain adequate physical controls and protections for any server or system on which any Data may reside, encrypt any Data that is in transmission, and encrypt any Data located on any storage media.

However, as effective as encryption technology is, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that information you supply won't be intercepted while being transmitted to us over the Internet. Any transmission of information by you to our Mobile App or otherwise is at your own risk. In the event of a security breach, we will use diligent efforts to promptly remedy and prevent any continuation or recurrence of any unauthorized access or use.

Mobile App may contain links to other sites and other services (e.g. whatsapp, zoom, google meet and jio meet). We are not responsible for the privacy policies and/or practices on other sites or apps. When following a link to another site you should read that site's / app’s privacy policy.

What personal information can I access?

Through your account settings, you may access, and, in some cases, edit or delete the following information you've provided to us. The information you can view and update may change as the Mobile App changes. Please note that any information that is automatically uploaded from a Product to the Mobile App, or collected otherwise from You by us, cannot be later changed or updated.

Deleting your profile and information

You can always opt not to disclose information to use, but keep in mind some information may be needed to register with us or to take advantage of some of our special features / Products. We will retain your personal information for a reasonable period or as long as the law requires. If you’d like us to delete/modify Information that you have provided via the Mobile App / website / URL or otherwise to us, please contact us at help@alyve.health and we will respond in a reasonable time. You may be able to add, update, or delete information as explained in section above. When you update information, however, we may maintain a copy of the unrevised information in our records. Please note that some information may remain in our private records after your deletion of such information from your account. We may use any aggregated data derived from or incorporating your personal information after you update or delete it, but not in a manner that would identify you personally.

What are the house rules at Alyve Health?

As a customer, you may sign up for both individual or group services (e.g. group breathing / meditation session). When you sign up for any session, you will need to follow standard community decorum in terms of dressing, participation and being respectful towards others in your group. If you find that any of our members are violating these standard rules, please write to us at help@alyve.health. We will not be liable for any such misbehaviour but if we identify such violations, we reserve the right to deactivate such members from our platform without recourse to refunds / compensation. Our endeavour will be to make your experience on our app as smooth and friction-free as possible.

Changes to this privacy policy

We may amend this privacy policy from time to time. Use of information we collect now is subject to the privacy policy in effect at the time such information is used. If we make changes in the way we use personal information, we will notify you by posting an announcement on our Mobile App / website / URL or sending you an email. You are bound by any changes to the privacy policy when you use the Mobile App or the Product after such changes have been first posted.

Refund Policy

1. Any sessions / classes / activity bookings bought by You are non-refundable, non-exchangable, and non-saleable. Any coupons redeemed by You are non-refundable, non-exchangable, and non-saleable.

2. Digital Services - You may request cancellation of your Digital Services, however the same must be done before the start date of the program. Refunds cannot be claimed for any partial-term period.

3. The Company and / or relevant service provider(s) / vendor shall have the right to cease/terminate relationship without any reason, and applicable amount or cash back (if any) or pro-rata refund, as the case may be, shall be refunded to You subsequently.

4. With regards to payments, the Platform shall not be responsible for any unauthorized transactions conducted on our Platform using Your payment card or internet banking. The Platform shall not be obligated to refund any money to You in such instances.

Limitation of liability

We value your trust in providing us your Personal Information, thus we will use commercially acceptable means of protecting it. But no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security. You agree and acknowledge that we will not be liable for any claims in relation to the use of the App / website / URL, including but not limited to (a) your inability to access or use the App / website / URL or the services; (b) the failure of the App / website / URL or the services to accurately identify persons in your proximity; (c) any unauthorised access to your information or modification thereof (d) behaviours of others on our platform. Furthermore, when you use our product and offerings, you will receive advice, prescriptions and guidance from the experts and content in our product (mobile app and/or website). This is being provided to you with the sole intent of making you a healthier and happier individual. You agree and acknowledge that we will not be liable for any claims in relation to the consequences of such advice, prescriptions and guidance.
